What role did Donald Trump play in the violent storming of the US Capitol on January 6, 2021? A new court document provides information in the election fraud trial.
Donald Trump pleads "not guilty" in the election fraud trial.
A newly published court document provides a detailed insight into the election manipulation allegations against former US President Donald Trump. In it, special investigator Jack Smith accuses the Republican of having committed crimes in the fight to retain power after losing the 2020 presidential election. It is the most detailed list of evidence to date in the trial against Trump.
"The attack began with his accomplices the defendant carried out a series of increasingly desperate plans to overturn the legitimate election results in seven states he had lost," the 165-page document says. Trump is said to have knowingly lied to the public, election authorities and his own Vice President Mike Pence. "Although the defendant was the incumbent president during the conspiracies he was accused of, his plot was essentially private in nature," Smith's team wrote.
Trump's role in the storming of the Capitol
The document is related to the violent storming of the US Capitol on January 6, 2021. Trump is said to have deliberately incited his supporters to prevent the confirmation of Democrat Joe Biden's election victory. He was charged at the federal level in the capital Washington as a result of these events.
The indictment was reissued after the US Supreme Court ruled in July that Trump enjoys immunity for certain official acts. This decision forced special investigator Smith to adjust the charges against Trump accordingly in order to move the case forward.
The Supreme Court has granted Donald Trump extensive immunity from criminal prosecution. This has been sharply criticized by US President Biden, among others.
The former president and current Republican presidential candidate pleads "not guilty" and describes the charges as a "political witch hunt". According to Trump, the publication of the document is "an attempt by the Harris-Biden regime" to interfere in the US presidential election in November.
"These illegal actions by the Department of Justice, including the raid on Mar-A-Lago for a case that was dismissed, will end like all other cases - with a complete victory for 'President Donald J. Trump'," the Republican wrote on his online platform Truth Social.
Judge Chutkan: Trump must be brought to justice
The publication of the document - parts of which have been blacked out - took place after the responsible judge, Tanya Chutkan, decided to make it available to the public. Smith's team argues that Trump should be brought to justice for his "private crimes" "like any other citizen."
The prosecutors explain why Trump should not be immune from prosecution in the case, basing their argument on witness testimony, social media posts and direct statements from Trump, among other things. It is considered extremely unlikely that the trial in the case will begin before the US presidential election on November 5.
